The Status of Abortion in Missouri…

Within minutes of the overturning of Roe V Wade, Missouri’s trigger law purporting to ban abortion was signed into law and took effect – as of June 24, 2022. We are truly grateful and thankful to God who has been gracious towards us, in spite of nearly 50 years of judicial tyranny at the federal level, and cowardice at the local level. But, the law that now prohibits some abortions in Missouri does have its flaws.
It does not apply equal protection of the law to preborn children. According to the Missouri constitution, all persons are afforded equal protection of the law. What that means is that the same laws that protect born people are to protect the preborn, and if they don’t, they are in violation of our state constitution. It is therefore our duty to repeal the portions of the statute that conflict with our constitution and offer the same legal protections for all people – born and unborn.
Another flaw is the “medical emergency” loophole. While the language may seem benign, it opens the door to basically continue surgical abortion. Some readers will recall recent statements made by the head of the U.S. Dept. of Health, Rachel Levine, insisting that “Every major medical association agrees: gender-affirming care is life-saving, medically necessary, age-appropriate and a critical tool for health care providers,” when addressing transgender surgeries for children. If that is currently being construed to be life-saving, what do we think will be done with this loophole?
Then there is the questions about “chemical” or “drug induced abortions” Because of the general chaos, lawlessness and ignorance in our civil government, it doesn’t appear that there is consensus on what this law really means.
The president of Planned Parenthood was beside herself, having understood that Missouri had not only banned surgical abortions, but also their precious Plan B (pun intended), which is potentially more lucrative than their archaic forms of child sacrifice. According to some reports, some clinics and hospitals did not dispense abortifacients for a very short period of time, until officials released statements asserting that abortifacients where not included in this ban.
After reading the definitions contained in our statute, it seemed obvious that this legislation does include abortifacients, so it is understandable that clinics would readily stop dispensing them.
Here is how our Missouri statute defines abortion, according to this statute:
188.015. Definitions. — As used in this chapter, the following terms mean:
(1) “Abortion”:
(a) The act of using or prescribing any instrument, device, medicine, drug, or any other means or substance with the intent to destroy the life of an embryo or fetus in his or her mother’s womb; or
(b) The intentional termination of the pregnancy of a mother by using or prescribing any instrument, device, medicine, drug, or other means or substance with an intention other than to increase the probability of a live birth or to remove a dead unborn child;
Now, I’m no expert, but this is pretty clear.
It may be that some of our officials are ignorant of the mechanisms of certain drugs, or it may be that they do know and they are being disingenuous. I suppose it’s also possible that they didn’t bother to read it. While we can certainly inquire with them or educate them, the important thing is that we watch them and keep the pressure on to do the right thing. When they refuse to do the right thing, we need to replace them with men who fear God, hate bribery, and have courage.
Pray with us that God would grant repentance to those in places of authority, wisdom to know what is right, and courage to do it. But, if they do not repent, may God raise up men to replace them.
